The Data Protection Board of India is the independent regulator established under Section 18 to enforce the Act, inquire into breaches and impose penalties.
there shall be established, for the purposes of this Act, a Board to be called the Data Protection Board of India.
The Board is the enforcement body. It inquires into personal data breaches and complaints, directs remedial measures, and imposes penalties under the Schedule.
It is designed to function as a digital office, and its orders can be appealed to the Appellate Tribunal. Data Principals must exhaust a fiduciary's grievance process before approaching it.
After repeated complaints about a company's data handling, the Board can inquire, direct fixes, and impose a monetary penalty.
